תנאי שימוש ומדיניות – MISSTOKYO

1. הקדמה וכללי

MISSTOKYO היא פלטפורמה המוקדשת ליצירת חוויות טיול ביפן. האתר מציע מגוון שירותי תוכן ותכנון – החל מתוכניות דיגיטליות מוכנות להורדה (Ready to Walk), דרך תהליכי תכנון אישיים ומסעות תוכן (Japan Your Way / Deep in Japan / For Pros), ועד לייעוץ מקצועי ורכישת פריטי אמנות ועיצוב (Pieces of Japan).

מהות הפעילות: האתר פועל כמרכז ידע, תוכן ועיצוב חוויות. השירותים הניתנים הם שירותי תכנון, מחקר וייעוץ בלבד. האתר אינו משמש כסוכנות נסיעות, אינו מבצע הזמנות בפועל של שירותי קרקע (כגון טיסות, מלונות או רכבות) ואינו מספק שירותי הדרכה פיזית בשטח. כל רכישה או שימוש בשירותי האתר מהווים הסכמה מלאה לכל התנאים המפורטים במסמך זה.

2. פירוט השירותים ומדיניות ביטולים ושינויים

א. תוכניות דיגיטליות (READY TO WALK)
מהות השירות: סדרת תוכניות טיול יומיות להכרת יפן דרך עיניים מקומיות.
מדיניות ביטולים ושינויים: מעצם היות השירות מוצר מידע דיגיטלי, לא ניתן לבצע ביטול עסקה, לקבל החזר כספי או לשנות את מועד התוכנית שנבחרה לאחר השלמת הרכישה. תנאי זה תקף מרגע ביצוע התשלום, ללא קשר למועד פתיחת הגישה לתוכן או למועד שליחתו בפועל.

ב. תכנון אישי ומסעות תוכן (JAPAN YOUR WAY / DEEP IN JAPAN / FOR PROS)
מהות השירות: תהליך אישי של בניית מסלול ייחודי או מסע תוכן מקצועי המבוסס על היכרות ומחקר מעמיק.
מדיניות ביטולים: מאחר שמדובר במוצרי מידע ופיתוח תוכן, לא יינתן החזר כספי לאחר הרכישה או לאחר תחילת העבודה על התוכנית.
דחיית נסיעה: במקרה של דחיית הנסיעה, עשויה להינתן ללקוח (לפי שיקול דעתה הבלעדי של בעלת האתר) הזכות לעדכון התוכנית לתאריכים החדשים, וזאת במסגרת התוכנית האישית המקורית שנבנתה.

ג. פגישת ייעוץ (FINE TUNE SESSION)
מהות השירות: פגישה אישית לדיוק וזיקוק מסלול קיים.
מדיניות ביטולים: לא יינתן החזר כספי לאחר ביצוע הפגישה. שינוי מועד הפגישה יתאפשר בתיאום מראש בלבד.

ד. חנות מוצרים פיזיים (PIECES OF JAPAN)
ייצור ומשלוח: צילומים וחפצים אשר נאספים, מודפסים ונארזים ביפן לפי הזמנה אישית (Custom Made).
אחריות: האתר אחראי על הגעת המוצר במצב תקין לידי הלקוח. במקרה של אובדן משלוח או נזק מוכח שנגרם על ידי חברת השילוח, יישלח מוצר חלופי ללא עלות נוספת, בכפוף להצגת הוכחת נזק.
מכס ומיסוי: כל עלויות המכס, המע"מ או היטלי ייבוא במדינת היעד חלים על הלקוח בלבד ובאחריותו לבדוק אותם מול הרשויות המקומיות.
החזרות: לא ניתן לבטל הזמנה או להחזיר מוצר לאחר שעבר לייצור או הדפסה.

3. מחירים, מטבע והמרות

מחירי השירותים והמוצרים באתר מוצגים בדולר ארה"ב (USD$). במקרים מסוימים, ובכפוף להגדרות ספק הסליקה, החיוב בפועל עשוי להתבצע במטבע המקומי של העסק (יין יפני - JPY) לפי שער החליפין במועד העסקה. כל עמלות המרת מטבע, הפרשי שער או עמלות בנקאיות נוספות שייגבו על ידי חברת האשראי או הבנק של הלקוח, יחולו על הלקוח בלבד ולאתר לא תהיה כל אחריות לגביהן.

4. קניין רוחני וזכויות יוצרים

בעלות על התוכן: כל תוכניות הטיול, החומרים הלוגיסטיים, התכנים התרבותיים והמסלולים באתר ובשירותים האישיים הם פרי פיתוחה וקניינה הבלעדי של בעלת האתר.
הצהרת זכויות: © כל הזכויות שמורות – מסמכי התכנית וכל תוכנם נערכים אך ורק עבור הלקוח והנם פרי פיתוחו של עורכם ונחשבים לקניינם הבלעדי.
מגבלות שימוש: המידע והתוכן שנרכשו ישמשו אך ורק את הלקוח ולשם המטרה עבורה נמסרו לו. חל איסור מוחלט להעתיק, להעביר, להפיץ, להציג בפומבי או למכור את התוכן לצד ג' כלשהו בכל מדיה שהיא.
צילומים: כל התמונות באתר ובמוצרי PIECES OF JAPAN הן רכוש בלעדי של בעלת האתר. אין לעשות בהן כל שימוש (פרטי או מסחרי), להוריד או להפיץ ללא אישור בכתב ומראש.

5. הגבלת אחריות

המידע באתר ובתוכניות הטיול מתעדכן באופן שוטף, אך אין לאתר אחריות על שינויים בלתי צפויים בשטח (כגון סגירת בתי עסק, שינויי לו"ז תחבורה, תנאי מזג אוויר וכו'). האחריות על ביצוע הזמנות בפועל ובדיקת זמינות המלצות חלה על הלקוח בלבד. בעלת האתר אינה נושאת באחריות לכל נזק, פציעה, אובדן כספי או עוגמת נפש שייגרמו ללקוח במהלך טיול המבוסס על המלצות האתר. חובה על הלקוח לרכוש ביטוח נסיעות, בריאות ומטען מקיף באופן עצמאי.

6. פרטיות ואבטחת מידע

האתר אוסף פרטים הכרחיים בלבד לצורך מתן השירות (שם, אימייל, טלפון, כתובת ומידע רלוונטי לטיול). המידע יועבר לצדדים שלישיים (כגון חברות שילוח או ספקים מקומיים ביפן) אך ורק לצורך השלמת השירות שהוזמן. האתר משתמש במערכות סליקה מאובטחות ואינו שומר את פרטי כרטיסי האשראי של הלקוחות.

7. סמכות שיפוט ודין

על תקנון זה, ועל כל התקשרות או מחלוקת בין הלקוח לבין האתר, יחולו דיני יפן בלבד. סמכות השיפוט הבלעדית לדון בכל עניין הנובע משימוש באתר או מהשירותים המוצעים בו תהיה נתונה לבתי המשפט המוסמכים בטוקיו, יפן.
